(Grantee) Deed Memorial28 April 1738A memorial of an indented deed of assignment dated 28 April 1738 was made between Anne Gerrard of the town of Drogheda, County Louth, widow and relict of Thomas Gerrard late of Drogheda aforesaid, alderman, deceased, Samuel Gerrard of the same, brazier, executor of the last will and testament of the said Thomas Gerrard, William Newton Esq. of Kells in the county of Meath and Elizabeth Hale of Drogheda, widow, relict and sole executrix of Edward Hale, late of the same, apothecary, deceased, of the one part and John McDowell of the same, gentleman of the other part.

Reciting as therein is recited, whereby the said Elizabeth Hale, for and in consideration of the sum of £211 to her in hand paid, and the said Anne Gerrard, Samuel Gerrard and William Newton, for the sum of 5 shillings sterling to every of them in hand paid by the said John McDowell, the receipt of which said several sums is by the said deed acknowledged did, and each and every of them did, grant, bargain, sell, transfer, assign, release and confirm unto the said John McDowell all that and those the two houses and gardens measuring and bounding on the east on the town wall, on the southwest gate, on the north the tower next to the Lime Kill and to the west the highway leading to the old windmill or Dundalk. Also all that and those the four small parcels lying in land Sharragh formerly on alderman William Ford's charge measuring and bounding according to a map to a deed of lease in the said deed recited annexed, and also all that park lying near Baymore on the south side of the town of Drogheda aforesaid, containing by estimation 7 acres and 5 perches be the same more or less, bounding to Mr. Ball's land, north to Edward Jones's land, west to the land of Baymore on the south and to the road leading to Baymore on the east, together with all houses and improvements whatsoever made or erected on aforesaid premises and all the estate terms for years, right, title, interest, equity of redemption, property, claim, challenge and demand whatsoever, either in lower equity of them the said Elizabeth Hale, Anne Gerrard, Samuel Gerrard and William Newton, or any of them, of, in, or to the said premises by virtue of the several deeds of lease and assignment therein recited or otherwise howsoever.

To have and to hold the said lands, tenements and premises with their members and appurtenances unto the said John McDowell, his executors, administrators and assigns, to his and their use and behoof for and during all the rest residue and remainder of the several and respective terms of 51 and 61 years of the several leases therein recited then to come and unexpired at and under the yearly rents and covenants therein reserved and contained.

The deed of assignment was witnessed by William Sweet Love of the town of Drogheda, apothecary, and Cornelius McLaughlin of the same, merchant, and the memorial was witnessed by the said Cornelius McLaughlin and Michael Bird of the same, gentleman. The documents were duly executed, signed and sealed by all parties and the memorial was registered on 10 June 1738.1

Birth*December 1849Luemma McElwell was born in December 1849 in Ohio.3 
Name-SpellingsLuemma's surname, especially, and also her given name, have been found with several variations in spelling. Her name was spelled "L. Emma Mc Eliver" in Heaton Families II; the record of her son Homer's birth transcribed it "L. E. McElwee"; the record of her son Edwin's birth transcribed it as "L. Emma Mc'Elire"; and the transcription of her daughter Mabel's marriage spelled her name "Luemma Mcelwell" and in the handwritten marriage license application appears to us to be very similar as "Luemma McElwell". For the purpose of this project we have, without additional research or analysis, decided to spell her name as Luemma McElwell. The only clues we have to her father and mother is that their births were reported to have been in New Jersey and Pennsylvania, respectively, on the 1880, 1900 and 1910 census returns.4,5,6,7,8 
Marriage*1874She married, as his second wife, Charles L. Heaton, son of Jesse Heaton and Rachel Paul, about 1874.9,10 
Census US 1880*17 June 1880Luemma and Charles L. Heaton were enumerated on the 1880 census taken on 17 June 1880 at 121 East Federal Street, Youngstown, Mahoning County, Ohio. Charles was 34 years of age and a teamster, and Luemma was 31 years of age and keeping house. Their son, Edwin L., was 2 years old.8 
Census US 1900*1 June 1900Luemma Heaton was enumerated as the head of her household on the 1900 census taken on 1 June 1900 at 88 Iron Street, Youngstown, Mahoning County, Ohio. She was 50 years of age and was reported to be married, although her husband, Charles L. Heaton, was enumerated in a home for disabled soldiers in Jefferson, Ohio, and reported to be divorced. She indicated she had been married for 27 years and had given birth to five children, four of whom were living. She rented her home, which was a house, and all four of her surviving children resided with her in her household in 1900. Edwin L. was 22 years old and worked as a brakeman for the railroad; Mabel R. was 19 and worked as a stenographer; Paul J. was 16 years old and worked as a salesman; and Carrie E. was 14 years old and attending school.3 
Census US 1910*19 April 1910Luemma Heaton was enumerated on the 1910 census taken on 19 April 1910 at 929 West Woodland Avenue, Youngstown, Mahoning County, Ohio. She was recorded as 62 years of age and divorced. She rented her home, which was a house, and three of her children were enumerated with her in 1910. Paul J. was single, 26 years of age, and worked as a clerk in a steel plant; Carrie E. was 24 years of age, single, and had no occupation; and Mable R., whose husband had remarried to a second wife in 1909, would have been divorced. She was recorded, however, as married, 29 years of age, as having been married for nine years, and having given birth to no children. She worked as a stenographer in an office.11
