15 November 1710

Jonathan Pratt and Joseph Stockbridge were appointed Administrators of the estate of Jabez Pratt on 15 November 1710 in Plymouth County, Massachusetts Bay Province (New England). The Letters of Administration document stated that Jabez, late of Duxbury, had died intestate and that the administrators were to prepare and provide an inventory of his estate to the Probate Court before 22 December. The inventory, valued at about £54.65s.23p had already been prepared, however, by Francis Barker and Ebenezer Sprout on the last day of October 1710, two weeks before administration was opened. The inventory identified books, wearing apparel, a horse, saddle and bridle, a pair of oxen, 3 cows, a swine, a yoke and chains and other tools for husbandry, hay and fodder, corn, salt, pewter, wooden vessels, 8 pounds of butter, iron vessels for housekeeping, chairs, a table, stools and lumber, a small pot, a debt from Joseph Stockbridge, a parcel of apple trees and a mention of 2 items at a Taunton estate. An additional note dated 15 Nov 1710, the same date the administrators were appointed, stated that Elizabeth Pratt, relict widow of the deceased, had refused to administer the estate. No mention of his and Elizabeth's children, all minors, was found in the probate documents.²

(6th Son-in-Law) Probate Agreement

11 February 1741/42

Joseph Pratt, representing himself and his wife Lydia (Hawes) Pratt, participated in the discussion on 11 February 1741/42 to prepare and finalize an agreement between the heirs and assigns of John Hawes, late of Dedham, Suffolk County, Massachusetts Bay Province (New England), yeoman, deceased. The probate document identified each of the parties to the agreement, and their relationships to the deceased, as:

James Heaton of Rutland in the County of Worcester, yeoman, on behalf of himself and on behalf of his wife Eliony (Hawes) Heaton, one of the children and co-heirs of the estate of the deceased John Hawes.

James Heaton, again, on behalf of his brother Samuel Heaton of Hebron, in the County of Windham in the Colony of Connecticut, yeoman, and his wife Sarah (Hawes) Heaton, one of the children and co-heirs of the estate of John Hawes. James identified Samuel Heaton further by adding "alias Samuel Heaton, his brother, of Black River in the Jerseys in America, yeoman, and Sarah his wife, one of the children and co-heirs of the estate of John Hawes deceased."

Joseph Pratt of Dedham, yeoman, on behalf of himself and his wife Lydia (Hawes) Pratt, one of the children and co-heirs of the deceased John Hawes.

Ebenezer Ellis of Dedham, a wheelwright, on his own behalf and also on behalf of Samuel Everett. Samuel Everett was an heir of the deceased John Hawes as the son and only child of Mary (Hawes) Everett, late of Dedham, deceased, who had been the eldest daughter of the deceased John Hawes. Samuel Everett had assigned his share to Ebenezer Ellis

Elizabeth Hawes of Dedham, spinster, one of the children and co-heirs of the deceased John Hawes, on her own behalf.

Grandson John Hawes on behalf of himself and his brothers and sisters. They were all identified as the children of John Hawes of Dedham, deceased, who had been a son of the deceased John Hawes. The other grandchildren, his brothers and sisters, were not named.

Daughter-in-Law Elizabeth (Warren) Hawes, widow of Samuel Hawes, late of Dedham, husbandman, deceased, on behalf of herself and her children. Her husband, the children's father, had been a son of the deceased John Hawes.

The agreement was signed by James Heaton, Joseph Pratt, Ebenezer Ellis, Hannah Hawes, Elizabeth Hawes, John Hawes and Elizabeth (Warren) Hawes. On 10 March 1741/42 in Boston, Joseph Pratt, Ebenezer Ellis, Hannah Hawes, Elizabeth Hawes and John Hawes acknowledged the instrument to be their voluntary act, and on 31 July 1742 in Boston, James Heaton and Elizabeth (Warren) Hawes made their acknowledgements.⁶

(6th Son-in-Law) Estate and Land

11 February 1742

Under the 11 February 1742 agreement, Joseph Pratt and Ebenezer Ellis received 11 acres and 8 rods of land belonging to the estate as it was situated, lying and being in Dedham in the Old Field, so called, as it is butted and bounded on the land of the widow Elizabeth (Warren) Hawes southerly, and on the land of Eleazer Fisher easterly and southeasterly and on common land in part northeasterly and on the brook northwesterly and on the land of the estate of John Hawes, deceased, on all other parts. Joseph Pratt and Ebenezer Ellis were also to pay all the debts belonging to the estate plus £7 16s funeral charges. Joseph Pratt and his wife Lydia (Hawes) Pratt also received three acres of meadow near what was called South Meadow and bounded on South Brook northeasterly and on the land of John Mackenab easterly and on what was called Hawes Hill southerly to a certain dam, for their full share in the whole estate of their father, John Hawes, deceased. Additionally, they, and each of the other heirs, received a one-seventh part of 14 acres on Hawes Hill.

The agreement then outlined how each of the seven parts of the 14 acres on Hawes Hill was to be divided. Joseph and Lydia (Hawes) Pratt had the first lot, adjoining his meadow; James and Eliony (Hawes) Heaton received the second lot; Samuel and Sarah (Hawes) Heaton received the third lot; Hannah Hawes, the fourth and Elizabeth Hawes, the fifth; grandson John Hawes, the sixth lot; and Ebenezer Ellis, the seventh lot adjoining Old Field. The lots were to be southeasterly and northwesterly and to be of unequal breadth at the southeasterly end, and also have convenient cart paths leading from the brook, to and over each of the lots.⁶

The children in their household included 1 male under 10, who would have been son Alfred, 1 male aged 10 thru 15, who would have been son Micah and 3 females under 10, who would have been daughters Margery, Mary Ann and Anna.⁴

In his pension application dated 12 September 1832, John Bolton, husband of Margery Bolton, stated that he had resided at Raynham in Bristol County, Massachusetts during the Revolutionary War. After the war he lived one year at Taunton, also in Bristol County, and twenty years at Bridgewater, in Plymouth County. Next, for about the same length of time he lived in several other towns and at the time of his declaration was residing in Billerica village in the town of Tewksbury, Middlesex County, Massachusetts. It is believed that John's wife and unmarried children resided with him.⁵

Mary Pratt is included in this project because she is the first "Mary Pratt" candidate we have identified who could have been the Mary who married Elisha Bolton, if that Mary's maiden name was "Pratt". It's a long story. Almost nothing is known about Mary's identity before she married Elisha Bolton and research is currently in progress trying to discover her maiden name and something about her early life. The Byrams in America sources, both editions, stated that the Jabez Bolton who married Bethiah Ripley in 1767 was the son of "John Bolton" and "Mary Pratt". Unfortunately, no source was cited for the statement. It is uncertain if the John Bolton referred to was supposed to be John Bolton, who was actually Jabez' uncle, or John Bolton, Jabez' older brother. Whichever was meant, both are incorrect. Jabez' father was Elisha Bolton. Jabez' mother's name was Mary, however we have no evidence, and only the clue from this one source, that suggested her surname may have been "Pratt". Just in case, though, we have begun to look in Plymouth County for potential Mary Pratt candidates. At this point, only one, Mary Pratt born in Scituate in 1708, has been identified as possible. Our plan is to research her family in hope of determining if she and Mary (__?__) Bolton were the same person.^3,4
