Stabbed twice in the throat with a kitchen knife, Oscar G. Montgomery, 49 years old, 2338 Lansdowne Avenue, a factory foreman, was found dead at 7:30 o’clock Sunday night at the home of Henry Geiger, 1815 South Third Street. Geiger and Montgomery were fellow employees.

After an investigation, detectives flashed teletype orders for the arrest of John Kinslow, Geiger’s brother-in-law. Kinslow, who lives at the Geiger home, was not there when the body was found. The teletype bulletin specified that Kinslow was wanted on a murder charge. He and Montgomery had quarreled, the detectives learned.

Woman Finds Body

Gieger was asleep when Montgomery’s body was found by Mrs. Gieger on her return from a visit in the neighborhood. Her husband was on the bed where the body was lying.

Failing in an attempt to waken Geiger, Mrs. Geiger drove to the home of some friends, Mr. and Mrs. Charles F. Perkins, 659 Atwood Street, and asked for help. Mr. Perkins was thought to be at the home of Frank Pousardien, 545 Wainwright Street. Mrs. Perkins went there with Mrs. Geiger. Mr. Perkins was not there, but Mr. and Mrs. Pousardien and Mr. and Mrs. J. C. Phelps, 1013 South Floyd Street, who were visiting the Pousardiens, accompanied Mrs. Geiger to her home.

Mr. Phelps awakened Geiger. Police were told he exclaimed, “My God, what has happened?” and then collapsed. He was soon revived.

Pair Quarreled, Claim

The detectives established that Kinslow had spoken harshly to his sister, Mrs. Maggie (Kinslow) Geiger, Sunday afternoon in the presence of Montgomery who reprimanded him. Geiger told the police he did not attach any importance to the quarrel.

Geiger, who had been in Appleton, Wisconsin settling the estate of his father, and who had returned by motor, was tired and sleepy from the trip, and had gone to sleep, he said. He admitted he had had some liquor. No charge was placed against him.

Montgomery’s widow, Mrs. Anna Montgomery said her husband had taken her and their two sons, Charles Montgomery and Gerald Montgomery, for an automobile drive Sunday afternoon but Mr. Montgomery seemed to have been drinking. Mrs. Montgomery took the children and left the car.

Near Montgomery’s left shoulder was the knife believed to have been used to inflict the wounds. It is a kitchen knife with a blade about five inches long.

Jugular Vein Cut

Dr. Roy L. Carter, Coroner, said one of the stab wounds severed the jugular vein.

Montgomery was a native of Jasper, Indiana. Besides his wife and two sons, he is survived by another son, Edwin Montgomery, and three daughters, Miss Dorothy Montgomery, Miss Esther Montgomery, and Mrs. Mildred Jenne.

John Kinslow, 34 years old, who lives near Glasgow, Kentucky, was arrested on the street in Glasgow at Monday afternoon 4:30 o’clock at the request of Louisville police, who believe he killed Oscar Montgomery, 49-year-old foundry foreman, by cutting his jugular vein with a butcher knife at 1815 South Third Street Sunday. When apprehended, Kinslow refused to say anything, according to W. T. Bransetter, Barren County Deputy Sheriff.

Kinslow was returned to Louisville at 1:00 o’clock Tuesday morning. He was questioned, but would say anything except. “I don’t know” or “I don’t remember.” He was returned in custody of Detective Sergeants Charles Hazel, Charles Brown and Elmer Smith, the latter secretary of the detective department.

A charge of murder was registered against Kinslow. Sergeant Hazel signed the warrant preferring the charge. The detective listed as evidence $2.29 of $4 in Kinslow’s possession. The amount listed as evidence was allegedly taken from the slain man.

The man arrested had left the Geiger home when Mrs. Geiger returned and found Montgomery slain. Her husband was asleep in the same bed. Geiger, who had been to Appleton, Wisconsin to settle the estate of his father, was exhausted from the drive and had been drinking, and efforts of Mrs. Geiger to awaken him were futile. Mrs. Geiger started out to obtain help.

Mrs. Geiger said that Kinslow, who is her brother, was at the residence shortly before Montgomery came in. Geiger was asleep and the other two men talked for a while she said. Montgomery had been drinking and when Kinslow spoke gruffly to Mrs. Geiger, Montgomery rebuked him and an argument followed, the police were told.

When Mrs. Geiger left for the home of Mr. Perkins, 659 Atwood Street, her brother walked out, followed by Montgomery, she related.

It was about two and a half hours later when Mrs. Geiger returned and found Montgomery stabbed.

Funeral services for Montgomery will be held at 8:30 o’clock Wednesday morning at his residence, 2338 Lansdowne Avenue, and at 9 o’clock at St. Elizabeth’s Catholic Church. Burial will be in St. Louis Cemetery.

Kinslow Trial Resumes Today

Sister of Defendant in Fatal Stabbing Testifies for Commonwealth


Trial of John Kinslow, 42 years old, Glasgow, Kentucky, on a charge of murder will be resumed in the Criminal Court Tuesday. The indictment on which he is being charged alleges he stabbed Oscar G. Montgomery, 49, of 2338 Lansdowne Avenue, to death at the home of Mr. and Mrs. Henry Geiger, 1815 South Third Street, May 1.

Testifying for the Commonwealth Monday, the first day of the trial, Mrs. Gieger, who is Kinslow’s sister, said he had been visiting her home for three weeks before the tragedy and had acted so strange she believed his mind was affected. She related that Montgomery came to the house the morning of the stabbing and aroused her brother’s resentment by interceding for her when her brother spoke gruffly to her.

She left home after cautioning her brother not to say anything to Montgomery because Montgomery was drunk, she said, adding that she left the house and when she returned in the afternoon she found Montgomery in bed dead, a butcher knife at his side, and her husband in bed with him asleep.

Kinslow, who had disappeared, was arrested in Glasgow several days later although he denied knowledge of the crime, and said he had been drinking. He is represented by attorneys Frank E. Daugherty and Thomas Gardner.

Mr. Geiger, also a witness for the Commonwealth, gave little information about the stabbing. He said he was drunk at the time and knew of “no trouble between Kinslow and Montgomery.” The prosecution is being handled by Assistant Commonwealth’s Attorney Charles W. Logan.

John Kinslow Gets Life Term for Slaying of Louisville Man

Knife Murder Jury Out for One Hour; Defense Announces Plan to Appeal


A life sentence in the penitentiary was voted by a jury in the Criminal Court at 5:45 o’clock Tuesday afternoon for John Kinslow, Glasgow, Kentucky, for the murder of Oscar G. Montgomery, 2338 Lansdowne Avenue. The verdict was reached after the jury had deliberated for an hour and five minutes.

Announcing that he was “very much surprised” by the verdict, Frank E. Daugherty, attorney for Kinslow, at once presented an oral motion for a new trial and announced that he will put the motion into writing. If the plea is not granted Mr. Daugherty will appeal the verdict, he announced.

Kinslow was accused of cutting Montgomery’s throat May 1 at the home of Mr. and Mrs. Henry Geiger, 1815 South Third Street.

In summarizing the case for the Commonwealth, Assistant Commonwealth’s Attorney Charles W. Logan reviewed the evidence which he contended proved Kinslow guilty of the killing.

Closing arguments for the defense, presented by Mr. Daugherty, contended that the Commonwealth had failed to connect Kinslow with Montgomery’s death. Mr. Daugherty also pointed to testimony introduced by the defense in an effort to show that Kinslow was of unsound mind.

The testimony regarding Kinslow’s mental condition was given by his sister, Lallah G. (Kinslow) Ellis, identified as Mrs. W. E. Ellis, Dr. M. E. Loftus, Eugene Wooten and Nat Brady, all of Glasgow. Each asserted that Kinslow was irresponsible and subject to wild delusions.

They were preceded on the witness stand by Kinslow, himself, who stated that he couldn’t even remember meeting Montgomery that day. He recalled little of what happened, he said, except that he left the Geiger home about 2 or 3 o’clock in the afternoon and hitch-hiked to Glasgow where he arrived the next day.

His testimony followed Judge Alfred T. Burgevin’s refusal to give preemptory instructions for a verdict of not guilty. Mr. Daugherty argued in favor of the motion approximately fifteen minutes, after testimony for the Commonwealth was completed with statements of Mrs. Elizabeth Perkins, 659 Atwood Street, and Mrs. R. W. Dupree, 1810 South Third Street. They said they saw Kinslow arguing in Geiger’s yard with a man resembling Montgomery May 1, and that they saw him later try to enter the house.

That night Mrs. Geiger found her husband asleep in bed with Montgomery, whose throat had been cut. A butcher knife was at Montgomery’s side

When the Mayflower departed Plymouth, England on 6 Sep 1620, she was carrying 102 passengers, including three pregnant women. During the voyage one baby, Oceanus Hopkins, was born making a total of 103 passengers. Three days before land was sighted, passenger William Button died, so when the Mayflower arrived there were again 102 passengers. A full list of the passengers may be accessed by clicking on the PDF icon at the end of this section and those included in this project so far include adult males John Alden, Francis Cooke and James Chilton, adult females Susanna (Furner) Chilton, young male John Cooke, and young females Priscilla Mullins and Mary Chilton.

During the weeks ahead, while everyone still "lived" on the ship, the men explored the area looking for a place to build their settlement. Another baby, Peregrine (meaning "wanderer") White, son of William and Susannah, was born in America onboard the Mayflower on 20 Nov, the first English child born to the Pilgrims in the New World. The White's servant, Edward Thompson, died on 4 Dec, followed shortly by 7 year old Jasper More, one of the four illegitimate children placed on the Mayflower in the care of the William Brewster family by their mother's humiliated husband. Two of the other More children died as well. And, tragically, Dorothy May Bradford, William Bradford's wife, slipped over the side of the anchored Mayflower and drowned. In early December the group decided to move the ship and look somewhere else for a settlement location. The ship and its passengers left Provincetown Harbor on 15 Dec. Two days later on 17 Dec, the Mayflower dropped anchor at Plymouth Harbor and on 21 Dec the first landing party arrived at the site of what would become the settlement of Plymouth. The weather, however, was so terrible they could not begin work on shore for several days. In the meantime, the Mayflower had become a hospital ship, the passengers suffering from colds, coughs, fevers and scurvy. James Chilton had died even before the Mayflower arrived in Plymouth Harbor. Richard Britteridge passed away the day the ship arrived, and two days later Solomon Prower, the stepson of Christopher Martin, the ship's designated "governor", died. The following day Mary Allerton gave birth to a stillborn son.

By the end of January 1621, enough of the settlement had been built to begin unloading provisions from the Mayflower, however the emigrants' ordeal was far from over. With two and sometimes three people dying a day during February and March, almost everyone had lost a loved one. Christopher Martin died in early January, his wife Mary soon after. The Rigsdale, Tinker and Turner families were completely wiped out, followed by Susannah Chilton whose husband James had died while the ship was at Provincetown Harbor. The Chilton's 13 year old daughter Mary had become an orphan. Also orphaned that first winter were 17 year old Joseph Rogers, 12 year old Samuel Fuller, 18 year old John Crackston, 17 year old Priscilla Mullins and 13 year old Elizabeth Tilley, who also lost her aunt and uncle, Edward and Ann Tilley. By mid-March, William Bradford, Myles Standish, Francis Eaton and Isaac Allerton, who had three children between the ages of eight and four, had all become widowers. When William White died, his widow Susannah was left with their newborn son Peregrine and 5 year old Resolved. Susannah was the plantation's only surviving widow. By that first spring, 52 of the 102 who had originally arrived at Provincetown were dead. Half, however, survived. And, miraculously, the families of William Brewster, Francis Cooke, Stephen Hopkins and John Billington were completely untouched by all the disease. The remaining "Pilgrims" worked, prayed and fought together and their settlement of Plimouth Plantation in Plymouth Colony had begun.1,2,3

(Father) Research NotesEvidence indicates that Frances Murphy and Florence Eliza Jane Murphy, biological daughters of Edward Emmett Murphy, both believed their biological mother was Arminta Elizabeth (Ratliff) Murphy, their father's second, or possibly even his third or fourth, wife. Arminta raised the girls and certainly considered them her daughters. Confusion over biological relationships, of course, doesn't really matter, except for genealogical purposes. Maybe, if anyone really cares, DNA will one day solve the issue. For now, we'll explain our research findings and current thinking. Edward Emmett Murphy married, as his first wife, Mary A. Robinson, and they had a son, Thomas William Edward Murphy, born on 4 December 1865. Researchers tracking Thomas believed his mother died before 1870 because Thomas was enumerated, at 5 years of age, on the 1870 census in the household of his father's brother, William F. Murphy. Those same researchers also reported that Thomas's father married a second wife in 1874. We haven't ever found Thomas together with either of his parents.

For most of his life, Edward Emmett Murphy was able to do a masterful job of avoiding the census takers. We found him with his parents in Florence, Lauderdale County, Alabama, in 1850 and 1860, and are embarrassed to admit we have been unable to find him in any of the 1870, 1880, 1900 or 1910 censuses.

Edward Emmett Murphy married Arminta Elizabeth (Ratliff) Murphy on 23 April 1874, which would make our research a lot less complicated if Edward's two daughters, Frances Murphy and Florence Eliza Jane Murphy, hadn't both been born earlier than that. Frances was born on 31 March 1870 and Florence on 16 June 1873.

So... How many wives did Edward Emmett Murphy have? Was Mary A. Robinson the biological mother of all three of his children? If not, who was the biological mother of Frances and Florence? Or... Oops! Did Frances and Florence have different biological mothers? Whatever the truth, Arminta, Frances and Florence all considered Arminta Elizabeth (Ratliff) Murphy to be their "real" mother.7,8,5,4,3,9,10,11,6,1 
(Husband) Death6 October 1901Edward Emmett became a widower when Arminta Elizabeth (Ratliff) Murphy died on 6 October 1901 at age 57.6

The merged children of the couple were listed by the census taker in birth order, and Eva was listed first as the oldest. Her birth date was recorded incorrectly, though, as July 1894, and her age as 5 years, while she was actually, we believe, 12 years old and born in July 1887.1

Research Notes*Evidence indicates that Frances Murphy and Florence Eliza Jane Murphy, biological daughters of Edward Emmett Murphy, both believed their biological mother was Arminta Elizabeth (Ratliff) Murphy, their father's second, or possibly even his third or fourth, wife. Arminta raised the girls and certainly considered them her daughters. Confusion over biological relationships, of course, doesn't really matter, except for genealogical purposes. Maybe, if anyone really cares, DNA will one day solve the issue. For now, we'll explain our research findings and current thinking. Edward Emmett Murphy married, as his first wife, Mary A. Robinson, and they had a son, Thomas William Edward Murphy, born on 4 December 1865. Researchers tracking Thomas believed his mother died before 1870 because Thomas was enumerated, at 5 years of age, on the 1870 census in the household of his father's brother, William F. Murphy. Those same researchers also reported that Thomas's father married a second wife in 1874. We haven't ever found Thomas together with either of his parents.

For most of his life, Edward Emmett Murphy was able to do a masterful job of avoiding the census takers. We found him with his parents in Florence, Lauderdale County, Alabama, in 1850 and 1860, and are embarrassed to admit we have been unable to find him in any of the 1870, 1880, 1900 or 1910 censuses.

Edward Emmett Murphy married Arminta Elizabeth (Ratliff) Murphy on 23 April 1874, which would make our research a lot less complicated if Edward's two daughters, Frances Murphy and Florence Eliza Jane Murphy, hadn't both been born earlier than that. Frances was born on 31 March 1870 and Florence on 16 June 1873.

So... How many wives did Edward Emmett Murphy have? Was Mary A. Robinson the biological mother of all three of his children? If not, who was the biological mother of Frances and Florence? Or... Oops! Did Frances and Florence have different biological mothers? Whatever the truth, Arminta, Frances and Florence all considered Arminta Elizabeth (Ratliff) Murphy to be their "real" mother.4,5,2,6,7,8,1,3,9,10

Marriage*13 June 1897She married second Steven G. DeBoard, son of Enoch DeBoard and Mary Ann Dixon, on 13 June 1897 in Iron County, Missouri. Researchers have found it easy to confuse Steven Walter DeBoard with his father, Steven Gilmore Deboard, who married as his second wife Florence Eliza Jane (Murphy) Womack. Steven W. DeBoard was a veteran of World War I, married Violet Usser, and is memorialized on the Find a Grave website. He is connected there incorrectly, though, as the husband of Florence. Florence's husband was Steven Gilmore Deboard.13,14,15 
Census US 1900*14 June 1900Florence and Gilmore DeBoard were enumerated on the 1900 census taken on 14 June 1900 in Union Township, Iron County, Missouri. Gilmore's birth was recorded as June 1862, which would have made him only 39 years of age, although he was actually age 42. He was a farmer and had worked every month of the census year. Florence's birth was recorded as June 1872, making her one year older than her 26 years. They rented their farm, had been married for three years, and Florence reported she had given birth to only one child and had no living child. Gilmore's two children from his first marriage, Ellen and Walter DeBoard, were enumerated nearby, on the previous page of the township's census, in the household of Gilmore's parents, Mary Ann, recorded as "Martha" by the census taker, and Enoch DeBoard.16,17 
Census US 1910*22 April 1910Florence and Steven G. DeBoard were enumerated on the 1910 census taken on 21 and 22 April 1910 in Union Township, Iron County, Missouri. The "W" recorded by the census taker as Steven's middle initial should be a "G" as this was the household of Steven Gilmore Deboard, Steven Walter DeBoard's father. Steven Gilmore was 51 years of age and a general farmer and employer, and his wife Florence was 36 years of age. Steven could read but not write, and Florence could neither read nor write. They reported being married to each other for 14 years, that it was the first marriage for each, and that Florence had given birth to 14 children, 5 of whom were living. As far as we've been able to ascertain, it was the second marriage for each, they had been married to each other for 13 years, Gilmore had three children from his first marriage, at least two of whom were living, Florence had two children from her first marriage, and together they had three children. Four children were enumerated with them in 1910. Emmett Womack, Florence's son from her first marriage, was recorded by the census taker as Emmett DeBoard. He was 15 years old, worked on the home farm, could read and write, and had attended school within the census year. Thomas C. and Manirva, ages 7 and 6 years, respectively, were the couple's children, as was their baby Nettie, who was one month old. Enumerated in the next household on the same census page, was Steven's brother, John H., with their widowed mother, Mary Ann DeBoard, who had been recorded as Polly Ann.18,19 
Census US 1920*19 January 1920Florence E. J. DeBoard was enumerated as the head of her household on the 1920 census taken on 19 January 1920 on Annapolis and Crane Pond Road, Union Township, Iron County, Missouri. She was 43 years of age, a widow, could neither read nor write, and rented her home. Four children and a brother-in-law were enumerated with her in 1920. William T. DeBoard was 17 years old, could read and write, and worked for wages as a track laborer. Manirva E. and Nettie G. DeBoard were ages 15 and 9 years, respectively. Manirva could read and write, and both had attended school within the census year. Emmett B. Womack, a son from Florence's first marriage, was single, 24 years of age, could read and write and, like William, worked for wages as a track laborer. Florence's brother-in-law, John H. DeBoard, resided with the family as a boarder. He was single, 49 years of age, could read and write, and worked for wages as a grade laborer. William, Emmett and John all worked for a railway company.20

They owned their farm free of mortgage, and all five of their surviving children were enumerated with them in 1900. William E. was 11 years old, could read and write, had attended school for 3 months of the census year, and also worked as a farmer with his father. Emory L. was 8 years old, could read, but not yet write, and had attended school for 3 months of the census year; Emma M. was 6 years old, had attended school for 3 months of the census year, and could not yet read or write; Cammie L. was 4 years old and not yet in school; and Falby O. was 2 years old.13

John was 45 years of age and a general farmer on his own account, and Frances was 40 years of age. They rented their farm, had been married for 22 years, and Frances had given birth to 11 children, 9 of whom were living and enumerated with their parents in 1910. William E., who was recorded as Emmett W., was 21 years of age and worked on the family farm with his father; Emory L. was 18 years old, had attended school within the census year, and also worked on the family farm with his father and brother; Emmy M., Cammie L., Falby O. and Albert E. were ages 16, 14, 12 and 9 years, respectively, and all were attending school; Rosa O., Flora D. E. and Agnes E. were ages 5, 3 and 1½ years, respectively, and not attending school. John’s father, William Marlow, was also enumerated with the family in 1910. He was 97 years of age, a widower, and "retired on account of age."14

John was 56 years of age and a general farmer on his own account, and Frances was 49 years of age. They rented their farm and five of their children were enumerated with them in 1920. Albert was 19 years old, attending school, and also worked on the family farm; the four younger children, Rosa, Flora, Agnes and Olen were ages 15, 13, 11 and 7 years, respectively, and all had attended school within the census year.15 
Census US 1930*7 April 1930Frances and John A. Marlow were enumerated on the 1930 census taken on 7 April 1930 in Brinton, Pottawatomie County, Oklahoma. John was 66 years of age and a general farmer on his own account, and had employees, and Frances was 60 years of age. They owned their farm which was valued at $6,000.
