That year, he was absent for illness for seven months from his post as District Inspector in Limerick. Then, from 1874 until 1876, when he became District Inspector in Armagh, he was absent altogether. Further evidence that he may have had problems was provided by a deed of 1877. It recorded that his brother, William, acting as a trustee of Robert and Mary’s marriage settlement, took over the lease of the farm at Annaduff. In April 1880, Robert was listed on a deed as "of Armagh", although by that time he was actually in a mental hospital in Dublin. His wife Mary, on 7 March 1880, had had him committed to Hampstead, Drumcondra, a private mental hospital in the Dublin suburb, while she took up residence nearby at Alpine Lodge, Glasnevin. Robert, aged fifty-seven at the time, remained at Hampstead until his death twenty-one years later.2 |

It begins: Reciting that a marriage was intended to be had between Thomas Potterton and Eleanora Anne Hinds and that Thomas Potterton was seized and possessed of the lands and premises therein and herein after mentioned for the lives of Thomas Potterton, Alexander Potterton and John Potterton, and the lives of their heirs, under a legacy which contained a covenant for perpetual renewal and, on condition of the marriage and of the portion of Eleanora Anne Hinds, Thomas agreed to settle and convey the same upon the facts and for the uses and purposes therein, and to his wife afterward. Reciting also that Eleanora Anne Hinds was then possessed of a future payment of £600 sterling and that Eleanora Anne's grandfather, William Gerrard, late of Dormstown in the County of Meath, by his last will and testament devised and bequeathed to the trustees named therein, their executors and administrators and assigns, the sum of £1200 sterling in trust that they, his trustees, should pay the interest thereof to Eleanora Anne's mother Sarah (Gerrard) Hinds during her life and that after her death they should pay the principal sum of £1200 to such of her children she should, by her last will and testament or by any instrument in writing, appoint. And lastly reciting that Sarah Hinds, upon the fact of the marriage between Thomas Potterton and Eleanora Anne Hinds, had agreed to approve £600, one-half of the sum of £1200, to Eleanora Anne Hinds, her daughter in order to execute the portion or portions of Eleanora Anne, the sum of £600 to be paid and payable immediately after the death of her mother, Sarah Hinds, whereby Thomas Potterton, Anna Maria Donnelly and Hester Rynd, on the condition of the intended marriage and after the sum of £500 was paid in hand to Thomas Potterton and the sum of £600 sterling was agreed to be appointed to Eleanora Anne Hinds and, for providing a completed jointure and maintenance for Eleanor Anne Hinds in case she should survive her intended husband and for the settling and assuming the lands and premises herein after mentioned unto such uses, hunts and purposes as therein after expressed and declared, and on condition of 5 shillings apiece to Thomas Potterton, Anna Maria Donnelly and Hester Rynd by Henry Potterton and Rebecca Hinds in hand paid to Thomas Potterton, Anna Maria Donnelly and Hester Rynd and each of them granted, recused and confirmed unto Henry Potterton and Rebecca Hinds, their heirs and assigns__________ actual__________ by virtue of the Bargain and Sale Lease and statute therein recited: All that and those that part of the manor of Moyrath in the County of Meath and commonly called and known by the name of Ballaghtalion and part of Pubblestown containing by estimate 250 acres, 1 rod and 39 hectares profitable land planted measure more or less bounded on the north and east by the lands of Clonylogan and Moat Town, on the south by Woodtown, on the east by Pubblestown and Moyrath as by map thereof to the original lease of the lands annexed might appear or now____________, the manor lands, tents and premises, or any of them, was or were theretofore situated, known, described or distinguished or located with the appurtenances thereto belonging. To hold unto Henry Potterton and Rebecca Hinds, their heirs, and after the natural life and lives of James Potterton, Alexander Potterton and Thomas Potterton and of the survivor and survivors of them and for the natural life and lives of every other person whose name shall be inscribed in any rent which might therefore after be obtained thereof by virtue of letters of excuse for such rent subject to the payment of the rent and performance of the covenants in the Tenure of Lease under which same __________ then held upon trust to the use and behalf of Thomas Potterton until the solemnizing of the intended marriage and from the solemnizing thereof, then to the use of Thomas Potterton for the term of his natural life and from the determination of that estate in the lifetime of Thomas Potterton to the use of Henry Potterton and Rebecca Hinds their heirs and assigns during the life of Thomas Potterton upon trust to preserve the contingent uses and estates therein and herein after mentioned land nevertheless to permit Thomas Potterton and his assigns during his life to raise the rents, issues and profits for his and their own use and immediately after the decease of Thomas Potterton in trust to the use instead____________ Eleanora Ann Hinds and her assigns in case she should survive her intended husband and that there should be no issue of the intended marriage living at his decease or in case there should be issue thereof living at such decease and that all such issue should die before they, or any of them, die before the age of 21, then she should and might, every year during her natural life from the decease of her intended husband or from the decease of such issue, and or years after as the case might be, take there out to her and their own use an annuity or yearly sum of £130 sterling, and in case Eleanor Anne Hinds should survive her intended husband and that there should be issue from the marriage, one or more children living at his decease, then upon trust Eleanor Anne Hinds thereof should receive an annuity or yearly sum of £100 sterling in lieu of the annuity of £130 sterling last mentioned. The annuity, however to be paid, in case such issue should die before they, or any of them, should attain the age of 21 years, the annuities of £130 or £100, as the case might be, should be free of all taxes, charges and deductions____________ and payable out of the lands and premises to Eleanora Anne Hinds and her assigns half yearly on every first of November and first of January in even portions, the first payment of £130 or £100, as the case might happen to be, to be the first such day after the decease of Thomas Potterton or of the decease of issue who die before they___________ should attain the age of 21 years and to her in full for the jointure of Eleanora Anne Hinds with the usual clauses of distress and reentry in case of nonpayment thereof and subject to the annuity of £130 or £100 as the case might be to_________ settle ____________ Thomas Potterton should die leaving issue of his intended marriage one child only, whether son or daughter, then to the use of such and to the heirs or heir of his or her body subject to the proviso and bond that at 21 should be lawful for Thomas Potterton if an only child should be a boy, by any deed taken by him executed to charges, lands and premises_________________________ sum and sums of money not exceeding £2500 sterling unto persons_______ as he, Thomas, should so direct and if it should also be lawful the heirs of such only child should be a__________ by any such__________ to appoint for such person or persons or _______________________ Thomas should think fit all or any______________ with such sum as he, Thomas, should think fit not less however than the sum of £1200 to be paid_________________________ in lieu of the lands in case Thomas should think fit by deed so to direct same in case he, Thomas Potterton, should die leaving issue of his intended marriage two or more children, sons or daughters or one son and one daughter or more, then to the use of such children for such estates and judgments and in such shares as Thomas Potterton should by any deed or by this last will and testament appoint and for want of such appointment then to the use of all such children to share and share alike as tenants in common not as joint tenants and of the several and for the respective heirs of the body or bodies of such child or children, and for default of such, then to the use of Thomas Potterton, his heirs and assigns forever and whereby Sarah Hinds, in consideration of the intended marriage and of the provision thereby made for her daughter, Eleanora Anne Hinds, in case of her surviving her intended husband and for the issue of the intended marriage by fact of the executed power to her in that the half given to her by virtue of the will by William Gerrard granted, declared and appointed the sum of £600 sterling being one half of the sum of £1200 so bequeathed as of to Eleanora Anne Hinds, her executors, administrators and assigns to be paid and payable to Eleanora Anne Hinds, her executors, administrators and assigns from and immediately after the death of her mother Sarah Hinds. The deed of settlement was signed and sealed by participants Thomas Potterton, Sarah (Gerrard) Hinds, and Eleanora Anne Hinds, and was witnessed by Sarah's younger daughter, Martha Hinds of the City of Dublin, spinster, and Luke Tracy Kelly, attorney at law on 27 August 1813 and registered the same day.4 |

The deed began with a review of four pertinent events: William Gerrard's 1788 will and subsequent 1790 probate, the death of Matthew Hinds, husband of William's daughter Sarah (Gerrard) Hinds, before or in 1809, and the 1813 marriage settlement agreement for Thomas Potterton and Eleanora Anne Potterton. Reciting that William Gerrard of Dormstown, County Meath, gentleman, deceased, made his will dated 24 December 1788 and thereby, amongst bequests to his other daughters, bequeathed unto the Reverend Singleton Harpur, Robert Waller and James Gibney, his trustees, an amount of £1200 in trust that they and his survivors and the executors and administrators of such survivors, should place out the same at interest and permit his daughter Sarah Hinds to receive the yearly interest for her separate use. And further, that after the death of his daughter Sarah, the trustees, their executors and administrators, should transfer the £1200 to such of Sarah's children as should be then living, and that by her will she should approve and appoint his daughters Rebecca Hinds, Elizabeth, Anne and Catherine Gerrard executors. Reciting further that William Gerrard died without altering his will and that it was proved in the Court of Prerogative Probate granted to Elizabeth Gerrard, Catherine Gerrard, since married to John Small, and Anne Gibney, three of the executors named and that the £1200 bequeathed by the will to Sarah was secured by the bond of Robert Waller, deceased, then of Ministown in the County of Meath, Esq. bearing date of 22 February 1790 with an attorney's warrant for confession of judgment in the final sum of £2400 conditioned for payment of the principal sum of £1200 under the will of William Gerrard upon which Anne Gibney, Rebecca Hinds, John Small and Catherine his wife did, around 1809, obtain a judgment in the Court of Common Pleas against Robert Waller stating that Matthew Hinds, husband of Sarah, was since dead leaving his widow Sarah and three children, namely Eleanora Anne, Martha and John Hinds, all of whom had attained their respective ages of 21 years. Next the deed explained that, by an indented deed of four parts dated 26 August 1813 and made between Thomas Potterton, Anna Maria Donnelly and Hester Rynd of the first part, Sarah Hinds of the second part, Eleanora Anne, then Hinds, of the third part, and Henry Potterton, gentleman, and Rebecca Hinds of the fourth part, the deed recited that a marriage was intended shortly to be had between Thomas Potterton and Eleanora Anne Hinds, and reciting that £1200 was held in trust for Sarah, mother of Eleanora Anne, and that on the result of the marriage being accomplished, Sarah had agreed that £600 of the £1200 should be payable to Thomas Potterton immediately after Sarah's death; then the agreement witnessed that in consideration of the intended marriage and the £600, Thomas made a provision for Eleanora in case she should outlive him and her issue. The indenture further witnessed a deed in which Sarah, in consideration of the intended marriage, had made provisions for Eleanora Anne and did give, grant and appoint the £600, being one-half of the £1200, to Eleanora Anne, her executors, administrators and assigns to be payable to Eleanora Anne, her executors, administrators or assigns immediately after the death her mother, Sarah. Then it was witnessed that the marriage had taken effect and that Thomas Potterton, by virtue of his marriage settlement deed, was entitled to the £600 upon Sarah's decease and that Thomas desired to sell the £600 and had applied to Reverend Mungo Henry Waller who had agreed to the purchase. Thomas had agreed to accept £400, which Mungo had agreed to pay to him. The other parties to the deed had agreed to ratify and confirm the purchase and to relinquish to Mungo all their right, title and claim in default of an appointment by Sarah, or in case of the decease of any or all of her children in her lifetime, or in case Sarah should execute her power of appointment so as to otherwise disappoint Thomas and Eleanora Anne or their issue of the £600 or of any part thereof. The indenture witnessed that, upon execution of the agreement and in consideration of the £400 paid by Mungo to Thomas Potterton, and of £1 apiece paid to Eleanora Anne Potterton, Sarah (Gerrard) Hinds, Martha Hinds, John Hinds, Rebecca (Gerrard) Hinds, John and Catherine (Gerrard) Small and Anne (Gerrard) Gibney, Thomas and Eleanora Potterton, Sarah, Martha and John Hinds, did grant, bargain and assign, and Rebecca Hinds, John and Catherine Small, and Anne Gibney confirmed unto Mungo H. Waller, his executors, administrators and assigns, the principal sum of £600, and reciting that by deed and Memorial, Rebecca Hinds, John and Catherine Small and Anne Gibney did assign to Thomas Hinds as trustee, his executors, administrators and assigns, a judgment. It was thereby declared that the £600 was invested with Thomas Hinds in trust as to £600 and the interest thereof from the death of Sarah Hinds for Mungo H. Waller and the interest due and to grow due on the fact of the judgment in trust for Sarah Hinds, her executors, administrators and assigns for life. And after her decease, as to the monies secured by the judgment above, £600 for the person or persons whom Sarah should appoint. The deed and Memorial was signed and witnessed by each of the parties involved on various dates, and was registered on 4 May 1814.5 |

Whereby the said Sarah Hinds, in consideration of a marriage to be had and solemnized between the said James Matthews and Matilda Hinds, agreed to settle on the said Matilda Hinds, her executors, administrators and assigns, the sum of £600, part of a sum of £1,200 left her, the said Sarah Hinds, under the will of William Gerrard of Dormstown in the said county, Esq., her father, bearing date the 24 day of December 1788, which said sum of £1,200 was assigned in trust to Singleton Harpur, Robert Waller and James Gibney for the use of the children of the said Sarah Hinds with her then husband Matthew Hinds to the intent and purpose that she, the said Sarah Hinds, should receive and take the yearly interest thereof and to be free from the engagements or debts of said Matthew Hinds or any after taken husband. And upon trust that the said trustees, their executors or administrators, should, after the said Sarah's death dispose of the said sum of £1,200 amongst the said Sarah's children as she should direct, limit and approve. And whereas the said Matthew Hinds is since dead and has left issue by said Sarah three children, namely John Hinds, Matilda Hinds and Eleanor Anne who is married to Thomas Potterton. And whereas said Sarah under the power given her in said will, and with the approbation of the said John Hinds and Matilda Hinds on the intermarriage of said Eleanor Anne and Thomas Potterton, settled upon said Eleanor Anne the sum of £600, part of the sum of £1,200. And whereas in consideration of said marriage so to be had between the said James Matthews and Matilda Hinds, she the said Sarah, by and with the consent of the said John Hinds, Thomas Potterton and Eleanor Anne signing thereof, has agreed to appoint and settle the remaining sum of £600, part of the sum of £1,200 on the said Matilda, same to be paid her immediately after the death of the said Sarah, and to be her own property, and to be at her the said Matilda's sole disposal and free from the debts and engagements of the said James Matthews, her intended husband. The memorial stated that the deed contained other necessary clauses and covenants as to the execution thereof, and the deed and the memorial were executed and signed by all parties and witnessed appropriately.
