(Father-in-Law) Land to Be Sold30 April 1867Announcements dated 20 March 1867 of the scheduled sale on 30 April 1867 of the life estate of Patrick's son-in-law, Patrick Dillon, in part of the lands of Cloonagrassan East, with Patrick Balfe Esq. as petitioner, appeared in newspapers and other methods of notification. The prospectus regarding the sale reported the estate of Patrick Dillon, and of solicitor Henry Ffrench Esq. and Patrick's father Richard Dillon, Trustees, in part of the lands of "Clonegrasson, East", known on the ordnance survey as Cloonagrassan, containing 128 acres, 1 rood and 38 perches, statute measure, situate in the Barony of Ballymoe and County of Roscommon, and held in fee simple, was to be sold in one lot on 30 April 1867 at the Landed Estates' Court, Inn's-Quay, in the city of Dublin.

The descriptive particulars of the property stated that "the railway from Dublin to Castlebar passes through the lands, which are situate about half a mile from the Ballymoe Station of the Great Northern and Western Railway of Ireland. They are within four miles of Castlerea, and eight of Roscommon, by railway. The upland is a good arable soil, held by industrious tenants, who pay their total net annual rents of £68 8s. 5 ½d., punctually. There is a large quantity of bog attached to the lands, which makes them of great value."

The conditions of sale included historical information about the property's most recent previous sale transaction in addition to conditions included in the current sale. It reviewed the Indenture dated 16 June 1863 made between Patrick Dillon's father-in-law, Patrick Trears, of the first part, Patrick Dillon of the second part, and his father, Richard Dillon, and solicitor Henry Ffrench Esq., Trustees, of the third part. It provided, among other things, that Henry Ffrench and Richard Dillon, as trustees, would hold the said lands, premises and hereditaments upon trust, by sale or mortgage of the said premises, to raise the sum of £315 14s. 11d., and pay the same, with all interest due thereon, after the rate of 5%, to Patrick Trears, and his executors, administrators, or assigns, but subject to redemption thereinafter contained. And in the next place, and subject to the said sum of £315 14s. 11d., upon trust, to permit the said Patrick Dillon to receive the rents and profits of the said lands and hereditaments during his life, or until he should be found and duly declared a bankrupt, or shall take the benefit of any act or acts of Parliament now in force, or at any time hereafter to be made, for the relief of insolvent debtors, or shall make, do, execute, permit, or suffer any act, deed, matter, or thing whatsoever whereby, or by means whereof, the said lands and hereditaments, or the rents and profits thereof, or any part thereof, should or might be forfeited in, or become vested in, any other person or persons, or become subject to the debts of him, the said Patrick Dillon, in anywise so ever.

The life estate of the owner, subject to said mortgage dated 16 June 1866 for the sum of £315 14s. 11d., in the Lands of Cloonagrassan East containing 128 acres, 1 rood and 38 perches, was to be sold under the foregoing clause, which was inserted to defeat creditors.

A certified copy of said deed of 16 June 1863 was to be handed to the purchaser, and could be inspected by intending purchasers before the sale.

The conveyance of the owner's interest was to be made by general reference to the life estate, under the said deed of 16 June 1863, and the purchaser was not object to on that account.

The above mentioned mortgage was a charge on the Fee. The purchaser would, therefore, only be bound to keep down the interest thereon; if any further demand in respect thereof was made on the purchaser, he would be entitled to be recouped thereof out of the inheritance.5,6
(Party to Deed) Deed Memorial20 May 1873A memorial of an Indenture dated 20 May 1873 was made between Margaret (Dignan) Ffrench, wife of Henry Ffrench Esq. of the first part, the said Henry Ffrench Esq. of the second part, Margaret's brother, Philip Dignan Esq., of River View, South Brisbane Queensland, Australia, of the third part, Patrick Trears of Ballymoe in the county of Galway, merchant, of the fourth part, and the said Patrick Trears and Michael Broderick of Castlerea, county of Roscommon, merchant, of the fifth part.

Ireland’s memorial deeds are handwritten, and the microfilmed copies are often difficult to read. Additionally, we are uncertain, in some instances, that we have identified the correct townlands. In earlier times, how the name of a townland was spelled depended upon how the initial scribe heard the name pronounced, and then how future scribes interpreted what was written. As a result, the names and spellings of many Irish townlands were spelled differently from deed to deed, book to book and year to year. Attempts to standardize the spelling of Ireland’s townlands began around the turn of the 20th century. A townland’s Barony did not always remain constant, either. Changes were made as populations grew. Our own transcription that follows attempts to identify the correct townlands mentioned in the deed and spell them in the current (2020) standard form. Our placement of quotation marks around a townland’s name means we remain uncertain about our selection of the correct townland, or have used the spelling as we saw it in the deed because we couldn’t find a good guess. Our transcription follows, and we welcome suggestions and corrections:
